 What is an SSA?

SSAs (Special Service Areas) are mechanisms for funding expanded services and programs through a localized property tax levy. These enhanced services and programs are in addition to services and programs provided by the city.

What are the rules and regulations?

Per the most recent meeting of SSA 27 Commissioners, the following rules and regulations (this "Agreement") were adopted as they pertain to SHOP Lakeview & SHOP Lakeview Dollars (the "Program"):

 

 

1. Consumers must purchase from a minimum of 5 participating businesses.
2. Consumers must spend a minimum of $500.00 in total during a consecutive 90-day period, subject to the completion of applicable rules and regulations, shall then receive $50 in the form of a “gift certificate”—also known as SHOP Lakeview dollars.
3. Any one consumer may not receive more than $500.00 in SHOP Lakeview dollars in one calendar year.  All consumer redemptions in excess of $250.00 SHOP Lakeview dollars shall be held to the end of the program and subject to demand, paid pro rata.
4. Eligible Program shopping is contained to any consecutive 90 calendar days within the eligible dates of the Program.
5. SHOP Lakeview dollars are valid for redemption at any point during the Program prior to their expressed written expiration date.
6. Previous SHOP Lakeview participants must notify the Lakeview Chamber of Commerce in writing if they wish to discontinue their participation.  In other words, when you agree to participate once, you are automatically enrolled in future SHOP Lakeview programs.
7. Reimbursement to participating businesses for redeemed SHOP Lakeview dollars are available at any point during and within 90-days of the termination of the Program.
8. Business-to-business or service related industries are ineligible for the Program.
9. You may not purchase products during the Program for resale or commercial use of any kind.  This includes orders for customers or on behalf of customers or orders for products to be used by you or your friends, relatives, or associates in any manner.  Such purchases may result (in our sole discretion) in the rejection, withholding or refusal to honor the SHOP Lakeview dollars otherwise payable to you or others under this Agreement.
10. No SHOP Lakeview participant may directly or indirectly initiate enrollment of its customers in the Program without written permission of the Commissioners.  If we determine, in our sole discretion, that you have wrongly enrolled any person or entity in the Program, we may (without limiting any other rights or remedies available to us) reject, withhold or refuse to honor any SHOP Lakeview dollars otherwise payable to you or others under this Agreement.
11. No SHOP Lakeview participant may “aggregate” its customers’ purchases.  We reserve the right to reject, withhold or refuse to honor SHOP Lakeview dollars that do not comply with this or any of this Agreement’s requirements, or such other requirements that we periodically may establish.
12. This program is subject to the modification and/or termination in the sole discretion of the SSA #27 Commissioners at any time with or without notice.
13. Subject to this Agreement, we will provide you with graphical artwork and materials to use in connection with the Program, which you agree to prominently display.  We grant you a nonexclusive, revocable right to use the Program’s graphic image and text for which we grant express permission, solely for the purpose of identifying your store as a Program participant and to assist in generating sales.  You may not modify the graphic image or text, or any other of our images, in any way.  We reserve all of our rights in the graphic image and text, any other images, our trade names and trademarks, and all other intellectual property rights.  We may revoke your license at any time by giving you written notice.
14. You will only be eligible for redemption of SHOP Lakeview dollars if you fully comply with the above; we will not be liable for any monies or claims of any kind with respect to your failure to comply with the above, including to the extent that such failure may result in any reduction of amounts which would otherwise be paid to you pursuant to this Agreement.
15. The term of this agreement will begin upon our acceptance of your Program application and will end when terminated by either party.  Either you or we may terminate this Agreement at any time, with our without cause, by giving the other party written notice of termination.  Upon the termination of this Agreement for any reason, you will immediately cease use of all Program materials provided by or on behalf of us to you pursuant hereto or in connection with the Program.  You are only eligible to earn SHOP Lakeview dollars on sales of qualifying products occurring during the term and monies earned through the date of termination will remain payable only if the related orders are not canceled or returned.  We may withhold your final payment for a reasonable amount of time to ensure that the correct amount is paid.
16. We may modify any of the terms and conditions contained in this Agreement at any time in our sole discretion by making such changes available in our office.  Modifications may include, for example, changes in the payment procedures and Program rules.  IF ANY MODIFICATION IS UNACCEPTABLE TO YOU, YOUR ONLY RECOURSE IS TO TERMINATE THIS AGREEMENT.  YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING OUR POSTING OF A CHANGE NOTICE IN THE OFFICE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.
17. You and we are independent contractors and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties.  You will have no authority to make or accept any offers or representations on our behalf.  You will not make any statement that reasonably would contradict anything in this Agreement.
18.  We will not be liable for direct, indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages.  Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total SHOP Lakeview dollars paid or payable to you under this Agreement.
19.  We make no express or implied warranties or representations with respect to the Program or any products sold through the Program (including, without limitation, warranties of fitness, merchantability, noninfringement, or any implied warranties arising out of a course of performance, dealing, or trade usage).  In addition, we make no representation that the operation of the Program will be uninterrupted or error-free and we will not be liable for the consequences of any interruptions or errors.
20.  YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL OF ITS TERMS AND CONDITIONS THAT ARE NOT RELYING ON ANY REPRESENTATION OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
21.  This Agreement will be governed by the laws of Cook County without reference to rules governing choice of laws. Any action relating to this Agreement must be brought forth in Cook County, Illinois.  You may not assign this Agreement, by operation of law or otherwise, without prior written consent.  Subject to that restriction, this Agreement will be binding on, inure benefit of, and enforceable against the parties and their respective successors and assigns.  Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
